They were fully briefed on the risks of diving on an experimental unregulated submersible and chose to assume them anyway. The best they could claim is there was some fraud. But I fully believe Rush was high on his own supply so there was no intent to deceive. [/quote] The father and son weren't sophisticated actors. Unclear if They were just tourists. And waivers like that rarely hold up in court, especially when negligence is involved. The fact that the CEO didn't care about his own life is neither here nor there.
