There is case law on this topic in NC. And the open carry law has been in effect for a long time. Just displaying a gun isn't enough. You cannot, based on even displaying a gun, stop, frisk, search, demand to drop their weapon, etc. this is why the video is super important. Was there a verbal exchange? What was said? Did he point the gun at the police officer (that would be different, that is not just displaying)? But getting in and out of your car, with a gun on your belt or in your hand, isn't enough under NC law to pose as a threat. [/quote] BS on the gun on your hand scenario. [/quote] What gun? There was NO gun according to his own family who know him best. They say he was holding only a book when a black police officer shot him due to racism.
