If you are starting from the premise that there shouldn't have been any live ammunition on set and that the guns should not have been taken off set then there's a problem right there. Unless you can prove Baldwin knew that the guns had been taken off set and loaded with live ammunition then I don't see how you get to "commission of a lawful act which might produce death in an unlawful manner or without due caution and circumspection." We'll see what comes out at trial (if there is one) but the other factor is that Baldwin wasn't aiming at the victim specifically. He was going through his actions for the scene and "aimed" in their direction. That's not a reckless act if you think there's no possibility the gun is loaded, which is certainly what his attorney is going to argue.[/quote]
