It's a legal obligation of the DH to his Ex and child, enforceable by contempt sanctions in court. If you want to be a truly evil stepmother and insist he go to court to get child support reduced, god speed to you. [/quote] Actually it does.[/quote] Normally all income each partner earns goes to the marital assets, but child support does not operate like this, otherwise the couple’s joint income would be considered as available for child support (because what’s half bioDad’s is half newWife’s but also vice versa). Child support is typically calculated of off the biological parent’s individual income, not the couple’s. [/quote] I think what the PP means is that since marital assets (i.e. bio parents income) are used to pay the CS the new spouse gets a vote on whether the bioparent contributes more than the required amount. Obviously this assumes the bioparent would be eligible for a modification. I don't really take a position either way on it because honestly it doesn't matter. CS was designed to be modified if the numbers that go into the worksheet vary significantly so either party can request it to be adjusted up/down if they can make a showing of materially changed circumstances.[/quote]
