There was a trial recently in Tampa where the killer raised this stand your ground defense. The killer was a tow truck driver who illegally and improperly towed individuals' cars. When people went to retrieve their cars, the driver would not release them. A man got in his car and began to drive off the lot. The tow driver stood in front of the moving car. When the driver would not stop, the tow driver shot the man dead. He then said he was in fear of his life. The jury found him guilty of second degree murder.

A judge is now considering the issue in a different case involving two grown men fighting on a play ground. A gun appeared in the middle of the melee and one man is dead. Killed in front of his ten year old. The killer's defense is the Florida stand your ground statute. The judge must decide whether their is enough evidence to dismiss the charges based on the statute. If she dismisses the charge, the state can appeal. If she does not dismiss based on the statute of stand your ground, the defendant can still raise a self defense defense at trial. [/quote]
