Due to substantial concerns I have regarding the encroachment on the separation of powers between the legislative and executive branches established in the Home Rule Act, I am returning the "Hardy School Disposition and Lease Authorization Emergency Amendment Act of 2016" unsigned.

The Home Rule Act reserves to the Mayor the authority to to dispose of surplus District property. This bill would encroach upon this executive function by selecting a specific entity to which a property would be disposed. Although the bill does not mandate the disposition, the legislation is an overreach of the Council's legislative authority as the Executive is the proper body to initiate disposition of District property.

Although I am returning the bill unsigned, my action should not be interpreted as opposition to the disposition of the Hardy School to the Lab School. I have directed agencies within my Administration to begin discussions with the Lab School regarding the potential disposition of the property. If those discussions result in an agreement between the District and the Lab School on terms and conditions for the disposition of the property, I will transmit legislation to authorize the disposition to the Council. This course of action will allow for the public to weigh in on such legislation.
