Only takes 51 votes to nuke the filibuster
The Senate Majority Leader needs to allow a vote on the rule change. If the Majority Leader refuses to bring the issue to the flood, it will never happen. Frankly, I think Thune would resign his spot as Majority Leader before allowing a vote on a full range that nukes the filibuster (even if only for CRs/budgets).
Rules changes require a 2/3 vote.
No, they don't. McConnell got rid of the filibuster for SCOTUS nominees with way less than that.
Technically what he and Reid did were not rules changes.
Rules changes take 2/3 vote. There is a "nuclear option" Trump wants Thune to go nuclear. Thune says he is committed to the filibuster but has repeatedly sidestepped it. Formal rule change: The most direct way is to formally amend the text of Senate rules, like Rule 22, which governs cloture. This requires a two-thirds majority vote of senators present and voting, which is a high bar. Precedent change ("nuclear option"): A more plausible method is to use the "nuclear option," where a senator raises a point of order against a rule, the presiding officer rules, and then a simple majority of the Senate votes to overturn the ruling, establishing a new precedent.
