It is not true that companies are discriminating against American workers in favor of H1Bs. Sure you can find cases of individual managers especially at smaller companies doing that but generally it is not the case.  However, I don’t think companies are making real efforts to find a similarly qualified American worker when an H1B is available.  It is an on/off switch, either they don’t do H1Bs at all or they treat them exactly same as Americans, and they shouldn’t.  For that reason, I think $100k fee is actually a great idea for big banks and tech. If anything, I think it is too low.  It is a different story for academics, doctors, etc and they shouldn’t have different rules[/quote]
