Sure you can find cases of individual managers especially at smaller companies doing that but generally it is not the case. However, I don’t think companies are making real efforts to find a similarly qualified American worker when an H1B is available. It is an on/off switch, either they don’t do H1Bs at all or they treat them exactly same as Americans, and they shouldn’t. For that reason, I think $100k fee is actually a great idea for big banks and tech. If anything, I think it is too low. It is a different story for academics, doctors, etc and they shouldn’t have different rules[/quote]
