Our family is getting a cake tonight to celebrate. The kids are so happy to soon no longer be forcibly masked at school anymore. VICTORY!
Are we sure districts will comply? WTOP keeps talking about lawsuits, but I haven't seen any filed against the bill, just the EO.
The constitutionality of the bill has been challenged in court, since it takes away powers that have been traditionally given to locally elected school boards, and Democratic Del. Marcus Simon said the amendments will ultimately end up in court as well. The governor’s office and Republicans have said a simple majority vote is required for the bill to go into immediate effect; Democrats say a 4/5th majority is required. Simon said there are conflicting provisions in the state constitution saying that both things are true.
(https://wtop.com/virginia/2022/02/youngkin-signs-school-mask-mandate-ban-into-law/) (Funny thing how Del. Simon didn't mind when the House changed the rules in 2020 to use a simple majority vote to pass an emergency clause from Northam.)
It's state law now and the state constitution is very clear about the General Assembly controlling education.
What? Article VIII, Section 7 gives School Boards the power to supervise schools. The General Assembly has a role in standards of learning but not supervising schools. This law seems unconstitutional to me.
If so than SB 1303 was too…
