When you are overtly advocating for violent terrorism, this is a risk. He was espousing terroristic activity. It’s literally a law.
There is literally a legal process the United States has to go to to strip a green card holder of a green card, and this literally ain’t it.
I’m actually pretty curious about the intersection of green card law and law regarding terroristic activity. I don’t think this is a flat-out free speech issue or a flat-out terroristic threats issue.
You want to look up green card and first amendment rights IMO to get an outline of this. Terroristic threats would be a criminal charge and I don't know anything about any specifics of his involvement in the protests. Protection is not as secure as for citizens, even naturalized citizens. This has an overview: https://www.freedomforum.org/non-citizens-protected-first-amendment/ The Reno decision (1996) is not encouraging, and it was a strong majority decision (only one dissent, from Souter) favoring the govt. I couldn't tell if the parties had green cards, but it also related to Palestine.
Thank you. In general even if I find Khalil’s support of Hamas grotesque, I am an even stronger believer in the first amendment. I don’t think this is at all right (and I am generally in favor of schools kicking out the entitled brats that are disrupting education — but they aren’t the government). I have not seen anything truly attributed to him that would reach the level of terroristic threat, and he has never been charged as such. Just a lot of admittedly gross fanboying about Hamas. But, we allow people to have gross speech here.
For this alone we do not need to remove the conditions from his green card. Which does not have anything to do with his current situation. They could release him, wait for his conditional green card to expire, not renew it, and then legally deport him and they would be fully within their rights. His citizen wife can decide if she wants to leave with him or not.
