Roberts could have denied the application on his own but he did not. Instead, Roberts referred the matter for the full court because he wants to grant it but not on his own. He will vote with the majority to grant to vacate. That way, the emergency application is granted and there will be no record of who voted for it and who voted against it and no explanation as well. That way, the application is granted and Roberts didn't have to do it alone and do it publicly. Looks like the application to vacate will be granted by the full court unsigned unexplained but with precedential value.
Those idiot SB members didn't know they single-handedly ended any affirmative actions for K-12.
Geographic distribution a la Texas or California isn't affirmative action.
It's not just the geographic distribution, but also the "experience factor", as well as the racist intent. Essentially, the geographic distribution is being used as a proxy for race.
In general - I don’t think having some kids from every MS is a bad idea actually.
That's not a bad idea, for a different educational program. TJ's goal is to identify and educate the best students based on demonstrated capability. TJ is not a remedial learning center for under-served communities.
I would start, by having some kind non preppable surprise test, then.
All tests are preparable. That's the definition of any meaningful test - which is to test relevant knowledge or ability, which in turn is a reflection of how one has gained such knowledge or ability through learning and practice. Reading a history book to study the subject that will be covered on an exam is prepping. Learning how to solve geometry problems is prepping for geometry tests. Reading a novel and writing a book report is prepping for tests of reading comprehension. There is no such thing as a non-preparable test of relevant knowledge or skill.
Aptitude tests are not supposed to be prepped for (but people do it anyway). I'm pointing this out because your post is incomplete.
