At the SJ stage, yes.

Disputed facts are determined at the trial stage. The jury gets to decide which facts they believe. This is the purpose of the jury and they get to watch testimony and look at evidence and decide "this is what happened." Sometimes trials devolve because a jury can't decide or is divided. But usually they can reach conclusions of fact.[/quote]

Then why would you suggest that she can't win at the SJ stage due to "disputed facts." The disputed facts are the reason she will survive SJ. That's why her SH and retaliation claims are going to trial, if Wayfarer doesn't settle.[/quote]
