At what point does the Special Counsel appeal her decisions to the higher court?
She hadn't done anything that would allow for an appeal, but it seems she finally may have done so with the CIPA order.
CIPA order? Please help translate!
CIPA is the Classified Information Procedure Act. It governs discovery of classified material. Normally in a criminal case, neither side can appeal the trial judge's rulings before the final verdict and judgment. However, CIPA has some exceptions that allow the government to file an interlocutory appeal (an appeal before the final judgment). Cannon seems to be ordering the government to give classified information to Nauta and de Oliveira even though they are not charged with Espionage Act violations and therefore there's no reason for them to have it. That's likely to cause DOJ to appeal now.
