I think what you mean to say is that there’s conflicting evidence and the defense chose not to focus on this detail in the second trial because the condition of the body and the police misconduct were more compelling and less confusing themes to present to a jury. Anything relating to a conspiracy required them to prove a case within a case, and that  wasn’t a winning strategy. The timing of the Google search, which at least one witness lied to the grand jury about (she conceded this on the stand this trial!), is still very much in dispute.[/quote]
