[/quote] Being inside the car with thr keys is considered operating it, because you could make the car move. Same reason driving while drunk is a crime even if your car isn't currently violating any traffic laws. [/quote] Totally depends on the state, but in Maryland, if you're asleep in the back seat, and the car is turned off, and legally parked, it will likely not result in a conviction at trial. The test is much more complicated than "inside with the keys" Now, I'm sure a lot of people take pleas in those circumstances so they can keep a recommendation for a PBJ.[/quote] I have a friend in VA who was arrested for drunk driving for sleeping in their car at a Metro station parking lot. It was winter and they had the car on. Local prosecutor was going to charge them and my friend took a plea deal. Really derailed their life, as they lost their job and home was foreclosed. This was in 2008-2009 period. [/quote]
