Drivers are required to yield to pedestrians in marked or unmarked crosswalks and are at fault if they strike the pedestrian. The fault of the driver is not reduced if the pedestrian didn't "exercise due care." The pedestrian has the legal right of way, full stop. Now there are obviously people who argue that the fact that the driver could kill the pedestrian means the pedestrian should be careful, which is what pedestrians are fired to do (the "might makes right" argument). My kids are better trained to stop at crosswalks than the drivers running stop signs and failing to stop for pedestrians. But being able to kill someone does not make you legally able to or change the legal calculus of the pedestrian's responsibilities. [/quote]
