Even without a union, the employer must weigh the pros and cons of firing with a potential wrongful termination lawsuit...just like every other employer. If the teacher is a minority or in a protected class (age, Lgbt), then a lawsuit is almost guaranteed and would be costly to defend. In real life, it's rather difficult to fire people immediately.
