The charges would be violating the Anti-Deficiency Act. Nobody has ever been charged under that law, but it would be a federal offense. So, a federal law enforcement agency would have to make the arrests, perhaps FBI or Marshals. Chaffetz himself does not have police powers. So, all he can do is refer the violation to the authorities. I can imagine Holder giving him quite the run-around.

I think Chaffretz has just forced the issue of a Supreme Court case over this as forcing DC gov't to spend countless hours ( and tax payer money, right) suppling Congress with financial records on the cost of polling for the bill, educating police about the law, threatening to arrest anyone who implements is abuse of DC tax payers who are now , not just being denied a vote in the Senate, but the right for their own enacted laws to be law.

Ditto Congress's manipulation of Planned Parenthood and Hand Gun ban.

Time to file suit.
