WSJ reported he applied for asylum in 2022 so he wouldn't have been picked up for being an overstay.
Suspect’s history: Soliman had applied for asylum in the US and was denied a visa to enter the country in 2005, sources told CNN. He was in the US illegally, a Homeland Security official said today. The suspect entered the US in August 2022 as a non-immigrant visitor and was granted a two-year work authorization in March 2023. That visa expired earlier this year.
You don't get work authorization for a visitor visa. If you overstay a visa and file for asylum then DHS will say you are here illegally but they won't deport you until your asylum claim is heard. You also get work authorization after applying for asylum.
