I believe that unless the parent attends with the child (which some early education does), it's daycare and any judge would likely rule that it's daycare. However, it's going to cost a great deal in money and time just to get this issue before a judge. Is your ex so spiteful that he'd really rather pay a load in lawyer fees just to fight a reduction in daycare costs?
Yes, he is. My guess is that he is motivated by the idea that I would have to pay a load of lawyer fees.
If this is just CS and you both have W-2 jobs I wouldn't even bother getting a lawyer or, alternatively, I would just use DCSE. CS is straightforward and judges don't really get into the games he is playing. If you work full time and the program is full time then its childcare and thats the end of it provided it isn't absurdly expensive. Your agreement on the total cost of childcare is subject to modification too BTW so if your or his income went up or down a lot the percentage you each pay could fluctuate.
In my state if you want a change in CS payments you file with the courts. If both sides agree it’s easy. It didn’t occur to me that he would argue against this one. It seems stupid to do so.
PP here and DCSE can represent the case in court. Not represent you, per se, but the case which insures to your benefit. They can handle the garnishment but also the court appearance. Good luck.
