You do not have to 'break in' to property to get charged. In the case my old town they did catch some of thieves and charged then possession of stolen property in the plea deal. And public defender an unlocked car with keys in ignition. Good luck with anything beyond that. My friend caught a guy about to steal his car. He already was sitting in car about to do his thing. My friend chased him, he dropped his auto stealing stuff and as luck would have it a cop saw them caught up to guy. The story he told cop I was walking and cold and tired I saw an unlocked car and sat in it. This man started yelling at me and scared and ran off. The tools to steal car he dropped his accomplice must have picked up. Cop said usual another person. So friend tells arrest him. Cop goes on what? Attempted car theft is not car theft. I could charge him trespassing but that is a ticket at best or a warning. [/quote]
