Just because you call the individual an independent contractor, doesn't mean that the Deparment of Labor and the IRS are to agree with you. Also, federal FMLA only applies to employers with 50 or more employees; not a very small business. Finally, FMLA is unpaid leave, so the employer can use that money to hire a temp, etc. An employee can only be paid if she (or he) has paid vacation to be used during the FMLA leave. I think I is more likely the regulations you are trying to avoid are paying social securities contributions, unemployment insurance costs, etc. You know, the things that other people have to pau for to make up for yo not carrying your weight.[/quote]
