The owner for being an asshole or the dog for being vicious? You dont know that the dog was vicious - you just know that it reacted and that that reaction killed the other dog. When you are dealing with a size difference as described here that doesnt take very much. This is why we dont let our larger dog play with our guinea pig. He could kill it by just trying to play with it - it would take under a minute. I know the dog wasnt playing with the chihuahua but it wouldnt take much of a reaction, much less a vicious one for him to die - that is my point. And I dont know that there is a law requiring a person to be "good" and stay and help after an incident like this. Some people are assholes. But I am not sure he is under any legal obligation to stay around. And if the implication is that he allowed his dog to kill the little one - I dont think there is any legal obligation for him to physically intervene and risk his own safety when the other dog is off leash. You can argue that you would have or he should have but there are lots of reasons why people would not. [/quote]
