Vast majority of federal buildings fall under the executive branch therefore they apply whatever requirements the President imposes. . Biden's masking requirement does not bind the judicial branch or Congress. Apparently, Roberts "requested" that they wear masks but he did not make it a hard requirement. The other issue is that Gorsuch and Sotomayor sit next to each other. If she was on the other side of the dais, it wouldn't be a big deal.
