That may be her legal right, but then it really will look like she is "on trial." My expectation is she'll waive. [/quote] It's clear from ยง 24.2-237 that the Commonwealth's Attorney is directed to serve in a prosecutorial capacity in a proceeding where the official subject to recall is the "defendant." The statute has also been on the books for almost 50 years, and there haven't been constant recalls, so your speculation has no basis in fact.
