This actually could be a good outcome for the teacher, because the school's insurance was refusing to pay for the settlement she already won in the civil suit because it was claiming the policy is negated by the criminal actions of the AP and if the AP had been found guilty the insurance was going to refuse to pay. Now that the case was thrown out and charges cannot be refiled, the insurance can't use that excuse anymore as the AP wasn't and cannot in the future be found guilty of a crime that resulted in the shooting.
There is still the hurdle of the workers compensation exclusive remedy issue, which would eliminate her right to sue the school and negate her recovery. This verdict is not positive in that regard. If there were a criminal violation, it would take this case out of the exclusive remedy provision. This is terrible case. There really isn’t likely anything that will make Abby whole. It was probably a life ruining event.
You need to keep up. The civil trial has already happened and the workers comp issue was already decided by that judge who denied that claim.
You need to keep up. That issue is still on appeal.
