Will the court just appoint someone for him?[/quote] Yes, but there are a couple of issues here - first is that a judge is going to want to be as deferential as possible to a criminal defendant in order to ensure that their rulings are not grounds for appeal. So if someone is saying they are working to obtain counsel in a complex case like this, the judge is going to allow that until it becomes unreasonable (which is somewhat subjective). Second is that any counsel will need to hold a security clearance or be able to obtain one. There's probably only a handful of lawyers that are cleared and barred in Florida. And Nauta on his own probably can't afford any of them.[/quote] All true, but the judge can also appoint an attorney to represent him if he can't find someone willing to do it voluntarily. And the judge would not be restricted to public defenders -- in a very specific, sensitive case like this, a judge can appoint a private attorney who has the requisite clearance and experience, even if that attorney doesn't want to do it. Barred attorneys who practice in the court system are considered officers of the court who owe a duty to the goals of the justice system. That includes the 6th amendment right to adequate assistance of counsel in your own defense. I would not be surprised if the judge is waiting until Nauta exhausts all options, and then could appoint someone so the case can proceed. It will not be allowed to be postponed indefinitely.[/quote]
