Virginia employment lawyer here. If the plaintiffs' lawyer, Tom Spiggle, really did sue FCPS instead of FCSB, that's a truly amateur mistake that can get the case tossed prior to the merits. (I should know, I sued FCSB once...). You can't be a Virginia litigator without understanding that the School Board is the entity with the power to sue and be sued, FCPS is just a logo painted on some buildings. Hope he didn't mess this one up.
I've read the complaint and - whether the allegations are true or not - the whole thing reads like it was written by an amateur. Although I admire whoever they've got doing PR. They've orchestrated a great smear campagin.
Agreed. Often what happens in employment cases is that some hack drafts a complaint with a lot of salacious details and sends a draft to the defendants thinking it will lead them to settle before it's filed. If the defendants don't settle, the plaintiff goes ahead and files the complaint in a huff to embarrass the defendants, but the hack never bothers to make sure it complies with the pleading requirements. And then it comes back in the defendants' face, because either the complaint gets dismissed or people still think they are a bunch of idiots just looking for free publicity.
This doesn't even make any sense.....do you get plaintiffs and defendants mixed up often? clearly an amateur mistake!
