From MoCo's own Vision Zero report (PDF page 18): "Thirty-six percent of pedestrians and cyclists were at fault in severe and fatal collisions. When pedestrians are at fault, the top contributing circumstances were illegally in roadway, failed to give time and attention, clothing not visible, and under the influence of alcohol." Let's not blame only drivers. https://www.montgomerycountymd.gov/visionzero/Resources/Files/Vision_Zero_Data_Analysis.pdf
Despite the stupid concept that is contributory negligence, fault is not an “either / or”. Pedestrian may indeed have been jaywalking and the driver may be speeding. A jaywalking pedestrian may have been hit but would not have been killed without the excess speed.
Jaywalking is kind of a gentle way to describe running across Georgia or Connecticut Avenue in dark clothes at night, but there have been a number of people killed doing this. No need to be speeding.
If you live in the area you know that there are long stretches without crosswalks. These are not pedestrian friendly communities yet we are building housing based on the assumption not everyone is driving. So how do you expect people to get around? The pedestrian infrastructure on Georgia Ave in particular but also Connecticut and University is disgraceful.
The crosswalks they put in are stupid. They are just lines on the road. There are no lights to activate, and I can’t see how pedestrians would truly be any safer for being in that type of crosswalk at night than just jay walking. It’s a false sense of security.
