Republicans had a majority and could’ve demanded Trump name someone else, similar to Harriet Myers under W. A Republican was going to be confirmed to the court and that person didn’t need to be Kavanaugh. [/quote] +2 I say it again: Kavanaugh exists on the court because he’s the GOP’s middle finger to normal, non-extremist people. [/quote] That plus he sits on the Court because Mitch McConnell ensured that Merrick Garland didn’t. Had Garland been confirmed, Trump would have only had 2 SC picks, at most. Since Gorsuch was the first choice, he would have taken the appointment Kavanaugh was given, and if Republicans felt RBG had to replaced with a woman, Coney Barrett would still have her appointment. Brett would not be on the SC, and we might possibly not have the same Dobbs decision because I’m not sure Roberts would have been willing to be the deciding vote to overturn Roe. Having 5 other justices vote to overturn settled law gave him cover.[/quote]
