He thinks the whole thing is a sham and is willing to let them finish what they start at his expense.
He's evil but he's not an idiot. He doesn't think it's a sham, it's the exact opposite. He knows they have him dead to rights and the only thing putting up a defense will do is open him up to more trouble in the form of perjury charges and whatnot. The big talk is just for the rubes who actually do think it's a sham. When it really matters, he does what is best for Bannon, namely accept the inevitable and hope for the lightest sentence possible.
He knows that this judge got himself into hot water by not admitting the letter, then suddenly changed his mind but still made several rulings that prevent Bannon’s team from mounting a defense. Appeals is an Obama appointee so will be same thing, different day. If the SC hears the case, they will rule in Bannon’s favor because of the precedence set during the Nixon era. Usually the DOJ serves as a check and balance against a bias federal court/judge. In this case, they are working together, while the American people watch. No matter how many hearings are held before the 2022 elections, no matter how many arrested and jailed through the Federal courts, it won’t change minds. In fact, more and more people will move to vote R because they know it could be them next, who walk into a building waived in by police, and find themselves jailed without bail on misdemeanor trespassing charges.
