Chauvin’s criminal history score is presumably a 0 since I don’t know of any past convictions. How to read the grid: https://mn.gov/sentencing-guidelines/guidelines/about/ If Chauvin is convicted, the state plans to file a motion for a Blakely hearing to ask for an upward departure, with one factor being minors were present and probably why the children were called to the stand. I’m not familiar with how much the upward departure would be. There are some current questions about 3rd degree murder in this case that could be an issue on appeal, which is why the charge was dropped and then re-added last minute. A former MPD officer (Mohamed Noor) was convicted of 3rd degree murder in 2019, and the appeals process affected Chauvin’s case. [/quote]
