They don't have to. They just use the system to over turn affirmative action.  See prop 209 in CA.

It should occur to people that stereotyping is what got Harvard in this mess, and that stereotyping blacks as too dumb or lazy to get in on their own merit is as bad as stereotyping Asians as greedy selfish people.  However, what is wrong with studying hard?  Maybe if everyone studied harder they wouldn't need affirmative action today?[/quote]
