It’s not unheard of for the Supreme Court to allow deadlines to expire on orders like this that they simply don’t want to deal with. With the far more salient cases of Harvard and UNC on the docket for October, the relatively minimal impact of the process (complainant YM has gotten kids into the school both under the old AND new process, for example), and the weakness of the facts at hand, Roberts may decide that this isn’t the right case to use to attack affirmative action.[/quote]
