The existing law establishes a financial obligation for the US government. That isn't typically the case for the budget. The budget sets aside the money, but the government doesn't incur an obligation until an agency goes to spend it. Don't interpret that as any sort of defense of impoundment. That's a gross rejection of the separation of powers.
