Jury nullification is when a jury returns a NOT GUILTY verdict despite being convinced beyond a reasonable doubt that the defendant is GUILTY. If there is probable cause to bring charges, if a court has determined after the state presents its case in chief that the state has met the minimum burden under the law as set forth in the charging documents, then a guilty verdict from the jury is not a miscarriage of justice. How were her rights violated by police? What exculpatory evidence was suppressed by the state? It's a miscarriage of justice that the puke Fotis got off by suicide - he should be rotting in prison for a very, very long time.[/quote]
