[/quote] You cannot rely on an NDA to avoid testifying under subpoena and no judge would enforce an NDA in the face of a valid subpoena. You may be required to make some feint at resisting the subpoena to ensure you really are legally compelled. Most NDAs now are written to explicitly exclude a response to a validly issued subpoena from a court of competent jurisdiction, but Trump has such terrible lawyers that they probably didn’t include that. I don’t know enough about congressional subpoenas to know if they are self enforcing. It’s possible that a cautious person would say to Congress — look, I’m nervous about the NDA so you Congress need to go to a court and get an order compelling my testimony before you. I know everyone generally hates NDAs but I’m actually a fan of them. Most defendant arent ever going to pay out a settlement if they think the person is going to turn around and put the accusations all over the internet. But you need exception for cooperation with government agencies, whistleblowing, subpoena response, etc.[/quote]
