You are not a lawyer.  Obviously.  Here is the provision "(3)Other persons
It shall be [b]unlawful for any person to whom any return or return information[/b] (as defined in section 6103(b)) [b]is disclosed in a manner unauthorized by this title[/b] thereafter willfully to print or publish in any manner not provided by law any such return or return information. Any violation of this paragraph shall be a felony punishable by a fine in any amount not exceeding $5,000, or imprisonment of not more than 5 years, or both, together with the costs of prosecution."

It depends upon how and from whom the NYT got it and how that source obtained it.  Highly unlikely that the NYT is criminally liable for anything.  If the person who got it and provided it to the NYT was an authorized recipient, there is no crime.  That person might be civilly liable to Trump and subject to professional sanction and perhaps some other criminal statute.  The NYT MIGHT be subject to penalty if it could be proven that the NYT KNEW IN FACT the received the info from someone who had obtained it feloniously.
