Stocks would be considered marital assets and accessing them to hire a divorce attorney or fund an escape from a marriage could be difficult. As a SAHm going through a divorce now who was lucky to have access to funds from family for an attorney, it is very challenging to access cash quickly if you don’t have your own job, and if your partner files first you cannot liquidate marital assets. A spouse can file for divorce after emptying all of your accounts and while some of that money is legally yours, it takes months or years to claw it back and it doesn’t make cash available when you need it. That’s why you always need to have a small stash of actual cash (not in the bank) to survive for at least a week or two should you get totally screwed. [/quote]
