Sees two sets of feet in a stall. Surprise surprise, kids are in a stall together. This happens ALL THE TIME. Am I as the teacher going to intervene and try to get in that stall? No. What I AM going to do is leave and go find admin/school security because it’s their job to deal with those kinds of infractions. Given the interaction BEGAN consensually, the teacher likely had no idea it was going to turn into rape. Nothing may have been occurring at all when she walked in. As much as you might want to believe that students rarely meet in the bathroom to hook up or do drugs, that isn’t true: it’s incredibly common. She didn’t knowingly walk out on a rape - she walked out to probably go tell admin to deal with two students in the stall doing who knows what. [/quote] This is where we differ. If I walk in and see this, it doesn’t matter how often it happens. You make the students exit the stall - you saw it, you do something about it. Take photos of the feet if you have to. Put your phone on audio record. Then when the administration comes after you (which they probably will since they are cowards), you have things documented and you go straight to the media with a lawyer. There are ASSAULT charges we can face if we try to intervene in a physical altercation or interaction. Teacher probably assumed they were in the stall hooking up or doing drugs. Which to be fair- the female student HAD met with him consensually in the bathroom in the past so this wasn’t new or unusual behavior. She left to get a staff member who has the ability to break up that kind of interaction or force the stall lock or whatever. It’s like some of you seriously can’t grasp how legally vulnerable we are when working with KIDS. We can’t just go Rambo and bust down a stall door and drag kids out because we see two legs in the stall. She didn’t know an assault was imminent. She did know kids end up in stalls for lots of reasons all the time. BTW, this is a huge reason my principal doesn’t even want staff in or using the student restrooms. But what SHOULD have happened was the teacher to say GET OUT OF THERE NOW. And no one has confirmed that the teacher did in fact get school security or the admin. If that is in the report, post the page number. Easier to make up a villain than have any critical thinking skills. [/quote] The only one making things up is you. No one has said the teacher knew a rape was happening. But what she did know is 4 feet were in one stall. Which is inappropriate and she absolutely should have said something in the moment to the two people in the stall.
