since when are gyms in the business of accepting and rejecting customers who want to PAY THEM?  there's no liability for them.

That would be no different than a person is 100 lbs overweight going to McDonalds and MCD's turning them away for being too fat!  they could drop dead right there while eating a cheeseburger.  come on op!
