OP here. Since the person is activitely looking for work and I've seen the wording of the profile change I know it's active. Should also say this person never held the position - ex: Actual position was Assistant to Exec rather than Exec. In other words it's completely inaccurate. Hopefully it's right on a resume otherwise I would imagine you could lose an offer over that kind of 'mistake'.[/quote]

Given this further data, it's definitely fraudulent misrepresentation.  Not really sure there's anything you can do about it, but when references call to confirm employment the truth will out.  They won't be able to say what they were fired for, but definitely able to confirm the job title/position.

Not sure what LinkedIn would do about this, may be more of a stink than it's worth.  I wouldn't expect many clients would be contacting you via LinkedIn, would they?  [/quote]

Also, you could just send them a "friendly" note: "I'm the new Client Manager at My Firm and I've been in touch with a few clients who were surprised to hear you were no longer handling their accounts due to your LinkedIn information.  Would you be willing to update that to reflect that you're no longer with My Firm so that there's no confusion about whom they should contact in the future?  My Boss Who Is The Supervisor Who Fired You and I would really appreciate it.  Thank you."[/quote]
