A plea agreement is basically a settlement -- very hard for the judge to second-guess an agreement that is agreed to by both sides. You should be mad at the prosecutors who agreed to the settlement. "The ruling followed a plea agreement reached between defense attorneys and prosecutors after clinicians from both sides determined Danehower was legally insane at the time of the killing."
Seems like the psych experts created an impossible situation to get a conviction. I’m curious about what the facts were to make them believe he was legally insane at the time of the killing. I mean of course you have to be some level of crazy to do this, but why did 2 doctors find him insane in the legal sense? I am hoping at the least their findings hold up so that he is detained in a psychiatric facility for a very long time (ideally life). If he had been stalking the wife for a long time, then his insanity must be a fairly permanent feature and I don’t see how he could ever be safe for release. This is such a tragic case.
