Again the Arlington/Falls church judges all have to recuse themselves. Judge Schell, the wonderful retired jurist from Family Court, devoted hours and hours to this thing. He studied up diligently to understand the details, which of course did serve the interests of the affordable housing development cabal. Based on his deep study and perspective as an outsider, he denied the request of developers to be named an affected party to my friends’ lawsuit. Judge Schell recognized the developers being involved in the lawsuit would be a fiasco and only drain the plaintiffs’ funds. So he denied them standing to participate, since they NEVER should have bought SFH properties to build six-plexes unless they knew with 100% certainty that they would be allowed to build. Well, of course the developers appealed, and they won inclusion into the lawsuit as an “indispensable” party. Which is a joke because it necessitates a whole new trial. Without an immediate injunction, construction of these monstrosities and the types of tenants they attract will proceed almost immediately. Grant them everything they have spent so far on all aspects of the litigation right from the first consultation with their attorneys. Then they can go toe-to-toe and defeat these people just as they did with Judge Schell. They should not be punished for Judge Schell perhaps failing to dot an “I” or cross a “t”.[/quote]
