Hmmm...this wasn't true for us.  We are a heterosexual couple who used a surrogate to have our children.  We live in MD and our case was filed in the Montgomery County system.  We had a pre-birth order filed that established that we were the genetic parents of the child, that the surrogate had no biological ties to the child and was only a gestational carrier and our names were court-ordered to be put on the birth certificate.  They were.  The biological mother did not need to adopt the child and her name was put on the birth certificate.  This was all done in the third trimester, but before birth.  Copies of the court papers were sent to the hospital legal department for them to submit when they filed for the birth certificate. [/quote]
