Is it even illegal?[/quote] If you received a bio of the donor and the bio and genetics of the resulting child don't match, but the genetics of the resulting child matches the RE, then yes, it is fraud and medical malpractice both of which are liable to get the doctor's board certification to practice medicine revoked. At least, in the US. Not sure about other countries. Here's a case similar to that and the RE did lose his medical license.
