Good try tho![/quote] The Supreme Court has expressly said a student can’t be forced to stand for the Pledge of Allegiance. And while, yes, the Court does change its mind from time to time, that’s one that is unlikely to change. The simple fact that you call failing to stand for the Pledge “disrespecting” means that the action falls squarely into the type of political speech the 1st Amendment exists to protect. That’s why the Court has found all kinds of things related to the flag, including burning it, to be protected speech. Assuming the facts of this case are as reported, the school district will settle with the student and this will all go away because the PP’s are correct - the school district will lose this one if it goes to court.
