Child support takes both of your incomes into account in order to provide the most stable home environment. If he takes a lower paying job, regardless of his reasons, he can (and will most likely) get it reduced. You should look at taking a part-time job. I took classes as a graduate, 6 credits, and still worked full-time with two little ones. I would strongly advise against quitting your job altogether and relying child support, anything can happen. http://family-law.freeadvice.com/family-law/child_support/child-support-modification.htm
Op here- thank you. Want to clarify, im not counting on child support to survive. Im remarried and took the decision to go back to school with my current husband as he takes care of the rest, i was however counting on the child support to pay for all the extra for my daughter ie aftercare, clothes, activities ect as I dont want to put this extra burden on my new DH as he will be holding everything else while im in school
Ah, got it, makes sense. Well it sounds like he is still not reliable, or consistent, in paying child support. I would still look consider maybe doing some part-time work to cover whatever the child support doesn't recover. Of course child support can still be mandated but if her activities are $200 and he's only mandated to pay $100, there's nothing you will be able to do. If he gets behind, you can get in contact with your local child support agency or the appropriate channels and eventually recoup it. In addressing your original sentiment, it will still be based on his income if it is substantially different (not if it'll make a small difference). I hope that helps.
She needs to pay the $100. Child support is supposed to cover his portion, not hers. She also has to pay for a portion of her child's care. She can get a job or husband pays.
