I am sifting through all the financial and other planning that I'd rather have sorted out before my baby gets here (due in Sept) and wonder what others have done about wills? We don't have any unusual circumstances, but I know I am not going to want to deal with this stuff when I have a newborn/infant/toddler/etc etc so I may as well get it done now. Any reccommendations for an estate planning lawyer downtown that will do a simple will (ie: not enough assets to be complicated)? We don't need bells and whistles, just a legal doc, so I don't want to spend a lot of money in fees. |
you and your partner are very smart to create a living will and to do your estate planning before baby arrives. IMO all parents should do this to have the vital discussion of:
1. what happens if the mother dies 2. what happens if the father dies 3. what if you both died who would raise the kids, where? what assetts do they get? what are your wishes for them or the surviving spouse. As a grief counselor I must say some of the most horrific circumstances are when parents die and never had a will to outline their wishes for their children. It's the responsible, loving thing to do. best of luck |
My husband and I were in this exact same situation, no complicated financial stuff, but needed to make sure guardianship of our DD was covered just in case. We were pressed for time as he was going out of the country and didn't want to spend a lot, so we ended up using one of the online options and are happy with the results. It looks to cover the basics quite well, and we feel much better having something in place. As our financial situation changes and we have more assets and more things worth addressing I am sure we will revisit the documents and create something with an attorney, but this works for now. |
Similar to a previous poster, we too used an on line site. We looked around and found Legalzoom.com had a nice option. It was more expensive than some other websites but they do have someone review your documents before they are mailed to you, of the 3 tiers of options, the second and third allow changes for the next 5 years at no extra fee. We got a call from someone at legalzoom asking a few clarifying questions (mainly that we left things to our kids, who will be born later this month and we included in the will) We didn't have anything too complicated either but wanted to ensure things were lined up properly- with the trust laws changing in coming years, we didn't want to spend thousands of dollars only to really need to restart from square one. For the medical piece, we used "Five Wishes" which is a booklet you can buy on line and walks you through it. I got about 20 copies for about $20 and gave the many extras out to friends and family encouraging them to plan for their futures as well. (available from: http://www.agingwithdignity.org/5wishes.html). Good luck! So many plan to get this done, but don't until much later. You'll be so happy to cross this off your "to do" list! |
OP here -- I will look into Legalzoom this weekend. Thanks! |
