Can Trump declare new categories of crimes?

Yesterday the White House issued a new EO on child abuse. The EO focused on transgender kids, and stated that supporting gender affirming care for trans kids is engaging in child abuse — it discussed this at length. The EO said that those who engage in child abuse would be punished to the fullest extent of the law. It sounds like they are gearing up to arrest doctors or maybe even parents even who support trans care for minors.

Does Trump even have the legal authority to declare new forms of crime via EO? Respected medical and psychological organizations uphold gender affirming care for minors.

It is not a new form of crime. Child abuse is already a crime.

The order does not say much new. New criminal laws need to be passed by the state legislature https://www.whitehouse.gov/presidential-actions/2025/04/national-child-abuse-prevention-month-2025/

Like Virginia had buggery in books until not that long ago. Virginia also has a law that sex out of marriage is a crime.

This Executive Order refers to earlier Order that cut off “tax payer funding” for sex changes. When you polled voters, they did not want to pay for sex changes . Click and read the EO above

I am fully convinced that there is a group of posters who does nothing but refresh pages of this forum waiting for any topic dealing with transgender issues so that they can immediately begin posting the same tired arguments. They turn every thread with even the remotest connection to a transgender topic into a contest to see who can post the most ignorant remark. I have removed those posts from this thread.

As anyone who bothered to read the original post and comprehend any word other than "trans" will know, the OP was not asking for your opinion about transgender people. What the OP wanted to know is whether Trump can declare new categories of crime. The answer is that Trump can declare anything he wants. The important issue is whether those declarations have any meaning. Executive orders do not create law. Let me repeat that. Executive orders do not create law. Therefore, Trump can sign EOs until his Sharpie is out if ink and there will be no changes to law.
